The Supreme Court is set to hear arguments this fall on a case that could restrict or even stop the government from using the “disparate impact” theory to pursue cases against banks and mortgage lenders. The panel will discuss how regulators are using “disparate impact” and what may happen depending on the high court’s ruling.
