Gov. Mario M. Cuomo has denied that he supports a motion filed by an official of his campaign committee and the state Democratic Party against a taxpayer activist who is suing the state over the $800 million jobs bond act and other financial issues.

In an interview last week with Cuyler News Service in Albany, Cuomo said he had no knowledge of a motion intended to block further lawsuits by Robert L. Schulz, president of the All-County Taxpayers Association.

As leader of the Glens Falls, N.Y.-based group, Schulz has launched more than 20 suits against the governor, the state comptroller, and the Legislature.

"I have no idea [about the motion]. I don't care, because we are going to win." Cuomo said. He added that the motion was filed independently by the state Democratic Party attorney, Paul Whitaker, on behalf of the party, as well as the Cuomo campaign committee.

Schulz's suits charge constitutional and other legal violations in connection with several financing techniques carried out by the state in recent years, including the sale of bonds by the Local Government Assistance Corp., and the use of state money to advertise the $800 million Jobs for the New, New York bond act. The bond act will appear on the November ballot.

he motion against Schulz filed in state Supreme Court seeks a permanent injunction against further lawsults. The motion seeks to prevent Schulz from filing frivolous suits against the state.
