N.J. Charity Wins Curb On Group's Use of Name

A U.S. district court judge in New Jersey has granted a motion for a preliminary injunction preventing the Philadelphia-based Rainbow Card Foundation from using that trade name in the New York/New Jersey area.

Rainbow Foundation Inc., a 11-year-old New Jersey charitable organization, filed a lawsuit seeking the injunction, claiming that the dual use of the name could severely undermine its ability to raise funds and provide assistance to needy children.

The judge agreed, ruling that the Rainbow Foundation's efforts would be "irreparably harmed" by the continued use of the name in the area by Rainbow Card Foundation.

Travelers Bank USA and the Rainbow Card Foundation announced in October that they would issue a Visa card tied to lesbian and gay causes.

The preliminary injunction prevents Rainbow Card Foundation from using that name in New Jersey, New York City, Rockland and Westchester counties of New York State, and Fairfield County, Conn.
