Capital Briefs: OTS Guidelines Spell Out Appeal Rights

The Office of Thrift Supervision will permit appeals of nearly all supervisory decisions, application decisions, and examination findings.

Regulators' assessments of a thrift's loan-loss provisions and classifications of its loans also may be appealed.

The agency's final guidelines, published in the July 15 Federal Register, make clear that institutions may appeal ratings for any type of examination the OTS conducts, including safety and soundness, trust, and Community Reinvestment Act.

According to the guidelines, the OTS ombudsman will be liaison between the agency and those appealing its decisions and will protect the confidentiality of those who make complaints.

Institutions cannot appeal OTS investigations, charges, fines, or preliminary examination findings.
