In Brief: Lead Notice to Be Required in Foreclosure Sales

The Department of Housing and Urban Development and the Environmental Protection Agency will require lenders to tell consumers about the presence of lead paint in foreclosed properties put up for sale.

The new rules force lenders to provide would-be buyers with any records or reports about lead paint on a property and allow 10 days to inspect for such paint before the purchase becomes final.

Lenders must also give potential buyers a government pamphlet about lead paint.

The new rules exempt houses built after 1978, the year the government banned lead house paint. The effective date is Sept. 6 for lenders that own four or more dwellings, Dec. 6 for those with fewer.
