In Brief: Amex, Discover Resolve a Card Dispute

American Express Co. and Discover Financial Services, the credit card unit of Morgan Stanley Dean Witter & Co., have settled their differences over a trademark infringement lawsuit.

Discover sued Amex in November over a product called American Express Cash Back. Discover claimed that its trademark entitles it to exclusive rights to the term "cash back." The lawsuit also accused Amex of falsely claiming the Amex product is superior to the Discover card.

Amex Thursday said it had agreed to change the name of its product to the American Express Cash Rebate Card. New marketing material is to be developed to reflect the name change, and new cards are to be issued to customers when their cards expire.
