More ATM Disclosure Suits Filed

DALLAS – A New York man has filed a new string of ATM disclosure suits, just as credit unions appear to be getting their hands around another broad swath of suits brought by two Michigan retirees.

In suits filed in federal court in recent days, Don Anderson claims that Centric FCU, Coastal Community FCU and The People’s FCU have violated provisions of the Electronic Funds Transfer Act requiring that credit unions and banks post on the outside of their machines the fees they charge non-members/customers.

Anderson has filed 13 such suits in Texas over the past two months, naming Firestone Community CU, Monroe Telco FCU, First Light FCU, Capital One Bank, Union Bank, First National Bank, Metropolitan Bank, Liberty Bank, First Fidelity Bank, First Security Bank, BancFirst and First Bank of Chandler, among others.

The new suits come as numerous credit unions are agreeing to settle similar EFTA claims brought by Nancy Kinder and Ray Harrison, a Michigan couple who travelled the country photographing non-compliant ATMs. Four Michigan credit unions and one in New Mexico have announced settlements with the Michigan vigilantes in recent days.

In his suits, Anderson says the credit unions were barred from charging a “usage fee or similar fee for providing host transfer services because it failed to comply with EFTA’s notice requirements.”

Lawyers for Anderson did not return several phone calls seeking comment.
