Kim Phan provides guidance to clients on regulatory compliance matters, including interactions�with the Consumer Financial Protection Bureau. Ms. Phan's experience includes responding to�CFPB supervisory and enforcement activity, preparing non-bank companies to participate in the�CFPB consumer complaint system, and submitting public comments on proposed rules. She also�supports financial services companies in their interactions with the Federal Trade Commission,�including responding to investigations and assisting in complying with FTC guidance.Ms. Phan's practice also focuses on privacy and data security law in areas including the Fair Credit�Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), the Gramm-Leach-Bliley�Act, the Telephone Consumer Protection Act (TCPA), and other privacy statutes. Her work in this�area encompasses strategic planning and guidance for companies to incorporate privacy�considerations throughout product development, marketing, and implementation. Ms. Phan also�assists companies with data breach prevention and response, including establishing data security�programs prior to a breach and the assessment of breach notification obligations following a�breach.While in law school, Ms. Phan served as a law clerk to Nextel Communications, Inc., and to the�FTC's Office of Policy Planning. She has also interned in the Office of Congressman Virgil Goode,�the National Republican Senatorial Committee, and the National Republican Committee Press�Office.
