Two More CUs Sue Target

DALLAS — Employees CU here, and KC Police CU in Kansas City, Mo., have joined the ranks of CUs filing lawsuits against Target Corp. for costs and damages resulting from the massive holiday data breach.

The CUs filed a class action lawsuit Thursday in the U.S. District Court in Dallas, and were joined by the American Bank of Commerce, Wolfforth, Texas. The suit alleges the plaintiffs have incurred, and will continue to incur, damages to their businesses from the breach and expenses due to cancelling and reissuing credit and debit cards.

The credit unions join the $38 million First Choice FCU, New Castle, Pa., and $216 million Alabama State Employees CU, Montgomery, Ala., in suing Target. ASECU at the start of the year filed what is believed to be the first class action lawsuit by a financial services company against the large retailer.

The suit names Pittsburgh-based heating and refrigeration business Fazio Mechanical Services as being responsible for allowing the hackers into Target.

Attorney Richard Coffman, from the Beaumont, Texas-based Coffman Law Firm, filed the suit.

Both CUNA and NAFCU have estimated CU costs so far for the Target breach to be at least $30 million, expecting the total to rise significantly as more fraud losses hit.

Employees CU has $63 million in assets and KC Police $107 million.
