FDCPA Lawsuits Poised For Another Record Year

Lawsuits citing Fair Debt Collection Practices Act (FDCPA) violations were poised to hit 10,000 early this month after reaching 9,425 through Oct. 15, according to data from U.S. District Courts. Last year, the 10,000 mark for FDCPA lawsuits was not reached until Dec. 1.

Jack Gordon, CEO at WebRecon LLC, a company that tracks the data from the courts, expects the year-end FDCPA total will hit 12,000.

In the most recent reporting period of Oct. 1-15, consumers filed 516 FDCPA lawsuits, 129 Fair Credit Reporting Act lawsuits and 84 Truth-in-Lending Act lawsuits. There were an estimated 557 total lawsuits in the period, with many citing more than one violation.

An estimated 597 different collection agencies and creditors were sued in the Oct. 1-15 period, down from an estimated 697 in the Sept. 16-30 period.
