In Brief: Criimi Mae Sues Merrill, Citi, and Morgan Stanley

Criimi Mae Inc. filed suits this week against Morgan Stanley & Company International Inc., Citicorp Securities Inc., and Merrill Lynch Mortgage Capital Inc., alleging the three wrongfully seized or sold its assets.

Criimi Mae, a commercial mortgage lender, filed for protection from its creditors under Chapter 11 of the bankruptcy code on Oct. 5.

The company blames its bankruptcy filing in part on a Merrill Lynch collateral call of $20 million, made around Oct. 2. The collateral call was unnecessary, according to a suit filed by Criimi Mae against Merrill.

Criimi Mae is asking courts to order the three investment banks to turn over assets and/or the profits from the sale of those assets.
