SAN DIEGO – A purported holder of a patent on mobile and ATM deposits filed suit against San Diego County CU on Monday, claiming the credit union’s use of the technology is infringing on its patents.
The patent suit is the latest dispute over ownership of the key technology that is spreading through credit unions and banks. San Diego-based Mitek Technology is fighting a patent battle over its remote capture deposit technology with banking and insurance giant USAA, with both sides claiming rights to the patent.
In the San Diego County CU case the company, Content Extraction and Transmission LLC, claims the credit union’s deposit-taking ATMs and implementation of remote deposit capture is similar to the processes covered in its U.S. patent on “information processing methodology.”
A lawyer for the company told the Credit Union Journal it has not yet negotiated a license on the technology. “That will come in due course,” said Anatoly Weiser, a San Diego attorney representing Content Extraction.
The company also has filed suit against several other entities, including Bank of America and Wells Fargo.
A representative of the $5-billion credit union said the technology it uses is that of a third-party provider, Fiserv, which provides the technology for hundreds of credit unions and banks.
The company is seeking a declaration from the court that it is the rightful owner of the patents at question, a permanent injunction barring the credit union from using the technology, and damages.
