Consumers filed an estimated 400 Fair Debt Collection Practices Act lawsuits in the Aug. 16-31 period, down from 441 filed in the first half of August, according to data from U.S. district courts.
There were an estimated 467 total consumer statute lawsuits filed in the latter half of August, a number that includes 63 Fair Credit Reporting Act cases, 27 Truth-in-Lending Act lawsuits and 13 Telephone Consumer Protection Act lawsuits. Some lawsuits named more than one alleged violation, according to WebRecon LLC, a Grand Rapids, Mich.-based company that pulls the data from the courts.
An estimated 469 different collection agencies and creditors were sued in the Aug. 16-31 period, down slightly from 492 that were sued in the first half of the month.
Consumers have filed 8,384 lawsuits against collection agencies and creditors this year through August 31, a record-setting pace that easily tops the 7,700 lawsuits filed through this time a year ago.
The most active consumer attorneys in the Aug. 16-31 period were: Sergei Lemberg (16 lawsuits filed), John T. Flood (16) and Shireen Hormozdi (15). The most active attorneys year-to-date are: David M. Larson (232) and Craig T. Kimmel (189).
