Texas Borrower Sues Collector

A Texas woman suing a collection agency claims it threatened to garnish her to collect on a delinquent account.

Diana Walter's suit against CMRE Financial Services Inc. claims CMRE violated Texas and federal debt collection laws. According to the lawsuit, the agency placed collection calls to Walter with "intent to annoy by calling before 8 a.m. and after 9 p.m."

Walter states she did not received written notification from the defendant within five days of the initial communication. She also states the defendant hung up on her during collection phone calls.

The suit says the agency told Walter, "You need to pay the debt or we will be forced to garnish your wages."

It also called her at her place of employment after she asked it to stop, the lawsuit claims. alter is asking for an award of actual damages, statutory damages, costs and attorney's fees.

A jury trial has been requested.
