SAN DIEGO – Mitek Systems, Inc., which is in a major court battle with USAA over the patent to mobile remote deposit capture, filed suit in federal court yesterday against Top Image Systems, saying the Israeli firm is selling a knock-off version of its mobile RDC.
Mitek is seeking damages against TIS America and an injunction to prevent the company from selling its own mobile imaging products, called MobiCHECK.
The new suit come as Top Image Systems is showing its suite of content capture solutions, including MobiCheck, MobiPAY, MobiFLOW and MobiCLOUD, at this weekend’s RDC Summit in Orlando.
Mitek was the first vendor to market a mobile remote deposit system for smartphones and claims more than 150 credit unions have signed with it for its Mobile Deposit RDC, including giants like University FCU in Texas and Mountain America CU.
Mitek has been issued 12 U.S. patents, with another 12 patents pending, covering the processes for depositing a check, processing the image, and creating a Check21-compliant image, on smartphones or tablets, server or any combination of such devices.
The new patent claim comes as Mitek and USAA, the San Antonio insurance giant, are fighting in court over rights to the RDC patents. Mitek claims a pilot program it was conducting with USAA entitles it to the patent rights. USAA claims it is the rightful owner of the RDC patents.
Lawyers for TIS did not return a phone call seeking comment.
