Heartland Payment Systems Inc. has agreed to pay American Express Co. a settlement of $3.6 million related to a data breach the processor disclosed in January.
The Princeton, N.J., processor said the agreement, announced last week, resolves "all intrusion-related issues between the two parties."
Hackers installed malicious software on Heartland's processing systems last year and obtained account data on millions of payment cards.
Heartland chief executive, Bob Carr, said in a press release that the deal "marks the first agreement with a card brand related to the intrusion."
Earlier this month a federal judge in New Jersey dismissed a consolidated class action against Heartland that resulted from the breach.
