Collection Agency Sued For Threatening To Garnish Wages

A collection agency is being sued for threatening to garnish a Texas woman's wages to collect on a delinquent account.

Diana Walter filed suit against CMRE Financial Services Inc. in the Eastern District of Texas, for allegedly violating the Texas and federal Fair Debt Collection Practices Act. According to the lawsuit, the agency placed collection calls to Walter with "intent to annoy by calling before 8 a.m. and after 9 p.m."

Walter states she did not received written notification from the defendant within five days of the initial communication. She also states the defendant has hung-up on her during these collection phone calls.

The agency, according to the suit, threatened Walter by stating, "You need to pay the debt or we will be forced to garnish your wages," the lawsuit states. The defendant is also accused of calling Walter's place of employment after she asked them to stop.

Walter is asking for an award of actual damages, statutory damages, costs and attorney's fees. She is represented by Dave Lilley of Alex Simanovsky & Associates in Wichita Falls. A jury trial has been requested.
