In March, 953 cases representing 1,043 plaintiffs were filed U.S. District Courts for alleged violations of the Fair Debt Collection Practices Act (FDCPA) and Telephone Consumer Protection Act (TCPA).
Case volumes were significantly higher than February totals and reflected the highest number of plaintiffs filing under these statutes in any one calendar month. Year-to-date case totals now total 2,551.
For all U.S. District Court filings in March, the six states with the highest filings were New York (105), California (104), Pennsylvania (87), Florida (74), and Texas (56). These six states represent 51% of all the FDCPA/TCPA cases filed in the U.S. and Puerto Rico in Federal Courts in March. Colorado has also shown increases reaching 55 cases for the month.
Additionally, more than 9% of all litigation filed for the month were filed in Districts that the plaintiff did not actually reside. Plaintiffs filing multiple FDCPA/TCPA lawsuits in March had the heaviest concentration in the following Districts: Colorado, Florida Southern, Michigan Eastern, Michigan Western, and New York Eastern.
