U.S. Trust Appeals Duke Case Ruling

U.S. Trust filed a notice of appeal with the New York Court of Appeals late last Wednesday concerning its dismissal as co-executor of Doris Duke's $1.2 billion estate.

The day before, the New York Supreme Court's Appellate Division rejected U.S. Trust's appeal of the original decision to oust the bank.

In response, the company wrote: "We feel this action is unjustified and agree with Judge Israel Rubin's dissenting opinion which states that 'the removal of the corporate fiduciary is not supported by any evidence in the record before us.'"

A U.S. Trust representative said the bank had no comment beyond its prepared statement.
