CHICAGO -
The suit, filed in U.S. District Court in Chicago, claims the three members were charged $2 to withdraw cash from one of the credit union's Chicago ATMs, even though the notice on the machines stated consumers may be charged a fee of $1.50 for use of the ATM.
The members also claim the ATM did not have a notice, required under the EFTA, stating that funds deposited may not be available for immediate withdrawal.
The suit requests class action status for everybody who used the machine during the period of the erroneous fee notice. Lawyers for the credit union did not immediately return phone calls seeking comment.
