A U.S. district court Judge in Delaware Jan. 15 dismissed a lawsuit Alliance Data Systems Corp. filed last year against Blackstone Capital Partners seeking $170 million, confirms a spokesperson for Dallas-based Alliance. "We are currently evaluating our legal options," the spokesperson tells CardLine. Alliance attempted to collect a "business-interruption fee" from Blackstone because the New York-based investment company backed out of a proposed purchase of Alliance (CardLine 4/24/08). The deal reportedly was worth $7.8 billion. Alliance claimed in the suit Blackstone violated its contractual obligations by extending acquisition negotiations with the U.S. Office of the Comptroller of the Currency. Alliance said the prolonged discussions caused the deal to fall through. The judge ruled against Alliance because "it failed to plead a viable claim for breach of the merger contract," according to court documents.
